Tres apuntes sobre la prueba del Derecho extranjero, los remedios ante el incumplimiento contractual y el concepto de “efficient breach”
Este trabajo analiza la Sentencia dictada por el Tribunal de Apelaciones del Séptimo Circuito de EE.UU. en el caso Bodum USA, Inc. v. La Cafetière, Inc. Varias son las cuestiones objeto de examen. En primer lugar, la aplicación del Derecho extranjero, su naturaleza procesal y los medios de prueba más útiles para acreditar su correcta interpretación por parte del Tribunal. En segundo lugar, los diferentes procedimientos probatorios civiles en el derecho continental y en el norteamericano, así como los remedios frente al incumplimiento en el Common Law y en el Civil Law. Finalmente, se evalúa de forma crítica el concepto de incumplimiento contractual eficiente al hilo del voto concurrente del juez Posner.

Bodum USA, Inc. v. La Cafetière, Inc. Three notes about proving the foreign law, the remedies for breach of contract and the concept of efficient breach
This paper analyzes the ruling passed by the Seventh Circuit of the Court of Appeals of USA in the case Bodum USA, Inc. v. La Cafetière, Inc. Several subjects are examined. Firstly, the interpretation of foreign Law by domestic Courts and how to prove the right meaning of it; secondly, the different remedies for breach of contract in the Common Law and in the Civil Law. Finally, this paper contains a critical review of the concept of efficient breach, following the thread of the concurring opinion of judge Posner.
