El presente artículo profundiza en la nueva regulación del art. 286 bis del Código penal, operada por la LO 5/2010, de 22 de junio, y trata de contribuir al estudio del nuevo delito de corrupción entre particulares. El análisis dogmático que se lleva a cabo se orienta fundamentalmente al bien jurídico protegido por el mismo: la competencia.

Corruption within individuals and defence of the competition

This article gets inside the new regulation of the article 286 bis of the Penal Law, introduced by the LO 5/2010, 22nd of June, and intends to make a contribution to the study of the new crime of corruption within individuals. The dogmatic analysis we are dealing with basically points to this legally protected interest: competition.
