La discusión sobre la necesidad de un Código penal europeo, o de un modelo de Código, como el Corpus Juris 2000, se intenta vincular con tanta claridad a los niveles más elevados de integración europea que incluso sus oponentes se esfuerzan por dejar claro que su posición no puede entenderse como euroescéptica. En esta situación se ha de plantear el problema de los fundamentos constitucionales del derecho penal de la Unión Europea, un debate que debe situarse sin duda en la perspectiva de los principios. De ese modo, se presenta en primer término la situación en los textos constitutivos de la Unión y en las decisiones del Tribunal de Justicia de las Comunidades Europeas. Posteriormente se examina en qué medida esta situación fundamental garantiza ­por tanto, también cuáles pueden ser en este momento sus deficiencias y las posibles soluciones a las mismas­ el principio de legalidad en su vertiente de legitimación del poder penal y como mandato de determinación, así como las consecuencias derivadas del principio de proporcionalidad.

European Criminal Law, principle of legality and principle of proportionality

The discussion on the need for a European Penal Code, or a Code model, such as the Corpus Juris 2000, so clearly attempts to link the highest levels of European integration that even its opponents make an effort to make it quite clear that their position cannot be understood to be Euro-sceptic. In this situation, an uncertain one, to be sure, we have to raise the problem of the constitutional bases of European Union Criminal Law, and it must be raised from the viewpoint of principles. Thus, and in the first instance, the situation of the texts constituting the Union and the rulings of the Court of Justice will be presented; then, an examination has to be made of the extent to which this fundamental situation guarantees ­also, therefore, what its defects can be at this moment in time and the possible solutions to them­ the principle of legality in its aspect of legitimation of the criminal power and as a mandate for determination, as well as the consequences arising from the principle of proportionality.
