Uno de los aspectos más conflictivos de la vigente Ley de Enjuiciamiento Criminal tiene que ver con el modo en que se aborda el problema del enfermo mental autor de un hecho delictivo. Tras exponer resumidamente los problemas que presenta esta regulación, se analizan en este trabajo las previsiones que al respecto se recogen en el Anteproyecto de Ley de Enjuiciamiento Criminal de 2020, comprobando si suponen realmente un avance significativo frente a la solución vigente.

One of the most controversial aspects of the current Law of Criminal Procedure has to do with the way in which the problem of the mentally ill perpetrator of a criminal act is adressed. After briefly exposing the problems that this regulation presents, the provisions that are included in this regard in the Draft Criminal Procedure Law of 2020 are analyzed in this paper, checking if they really represent a significant advance compared to the current regulation.
