El razonamiento: Cuando en una posible (¡!) realización del tipo no se manifiesta el dolus ex re de una determinada persona, entonces ha de recurrirse al comportamiento anterior a la acción —en sí mismo interno, privado— de los posibles (¡!) intervinientes para investigar sus posibles (¡!) representaciones delictivas. Esta intromisión en la esfera privada requiere una legitimación, que estriba en el interés general en el esclarecimiento de las causas de una perturbación perceptible. Si de dicho esclarecimiento no resulta una intención delictiva de la persona investigada, entonces la intromisión constituye un sacrificio forzoso de su privacidad en aras de tal interés. En ausencia de una perturbación perceptible, por mucho que la persona que actúa obre con dolo, no existe una tentativa de realización del tipo, sino solo el intento de una tentativa; pues la investigación de un posible dolo ha de tener lugar después de la de un hecho perceptible, y no al revés. De lo contrario, la cogitatio precedería a la actio.

The “Attempt” of an Attempt

The line of reasoning: When a person’s dolus ex re is not depicted in what might (!) constitute the actus reus of an offence, then the conduct of the possible (!) perpetrators prior to the action —in itself internal, private— needs to be examined in order to investigate their possible (!) criminal ideation. This interference with their private sphere requires a justification, which derives from the general interest in the explanation of the causes of a perceptible disturbance. Should no criminal intent be inferred from such an explanation, then the interference constitutes a sacrifice of their privacy for the sake of that interest. Whether or not the person acting has a criminal intention, in the absence of a perceptible disturbance her conduct is not a criminal attempt, but only the “attempt” of an attempt; for the investigation of a possible criminal intention has to take place after that of a perceptible deed, and not the other way around. Otherwise the cogitatio would preceed the actio.
