El despegue económico de China en los últimos treinta años es un fenómeno muy estudiado. En cambio, las transformaciones del sistema legal chino han sido poco analizadas hasta la fecha, y sobre todo en España. Este artículo pretende estudiar los pasos dados por la República Popular China hacia la consecución de un verdadero Estado de Derecho, a la luz en particular del poder judicial. Aunque las autoridades chinas son conscientes de las numerosas insuficiencias del sistema y están intentando reformarlo, muchas lagunas que subsisten minan tanto la eficacia como la independencia del poder judicial en China.

The Judiciary in China: Independent and Effective?

The economic boom of China of the last 30 years is a phenomenon that has been much studied. On the contrary, to date, the transformations of the Chinese legal system have only been little analyzed, especially in Spain. This article aims to examine the progress made by the People’s Republic of China in achieving a true Rule of Law, in particular, in the light of the judicial power. Even though the Chinese authorities are aware of the numerous insufficiencies of the system and are trying to reform it, many gaps remain which undermine the efficiency as well as the independence of the judicial power in China.
