La ley aplicable a los pactos sucesorios

El pacto sucesorio es una figura controvertida y compleja por la variedad normativa con que ha sido regulada. Esta diversidad se manifiesta vivamente en el propio ordenamiento español. El sistema español de Derecho internacional privado no proporciona una regla que se adecue suficientemente a la tipología y a los principios estructurales del pacto sucesorio. La singularidad del pacto sucesorio como instrumento para organizar la sucesión, frente al testamento, exige adoptar una norma de conflicto específica que integre los intereses de las partes y confiera suficiente flexibilidad y autonomía.

The Applicable Law to Agreements as to Future Succession

The agreement as to future succession is a controversial and a complex figure due to the variety of criteria with which this has been regulated. This diversity is strongly reflected in the Spanish system of laws. The Spanish system of private international law does not provide a rule that is sufficiently tailored to the type and structural principles of the covenant inheritance. The uniqueness of the agreement as to future succession as a legal tool to organize the succession, as related to will, requires the adoption of a specific conflict of laws rule that integrates the interests of the parties and that confers sufficient flexibility and autonomy.
