La representación tiene una importancia práctica indiscutible en el ámbito del Derecho, ya que potencia de manera extraordinaria las posibilidades de actuación de las personas. De esta manera, todo tipo de relaciones entre ellas se ven estimuladas desde el punto de vista jurídico y económico. Entre las distintas clases de representación destaca especialmente la denominada representación voluntaria, la cual permite utilizar la habilidad ajena para la conclusión de todo tipo de negocios jurídicos. A través de ella lo realizado por el representante afecta a la esfera jurídica del representado, quien será así responsable de esa actuación ajena. Este artículo estudia la regulación actual de la representación voluntaria en Derecho español desde la perspectiva de su aplicación jurisprudencial y, asimismo, poniendo especial énfasis en las disposiciones que sobre esa materia se contienen en la Propuesta de reforma del Código Civil en materia de obligaciones y contratos de 2023 y en las diversas iniciativas europeas e internacionales en materia de Derecho contractual.

Representation in contract law. Proposals for the reform of Spanish law from the perspective of European and international soft law texts.

Representation has an indisputable practical importance in the field of law, since it enhances in an extraordinary way the possibilities of action of individuals. In this way, all kinds of relationships between them are stimulated from a legal and economic point of view. Among the different types of representation, the so-called voluntary representation stands out, which allows the use of the skills of others for the conclusion of all types of legal transactions. Through it, what is done by a representative affects the legal sphere of the principal, who will thus be liable for the actions of others. This article studies the current regulation of voluntary representation in Spanish law from the perspective of its application in case law and, likewise, placing special emphasis on the provisions on this matter contained in the proposed reform of the Civil Code on obligations and contracts of 2023 and in the various European and international initiatives in the field of contract law.
