Niños y bestias en el arte y el papel de la moral pública como límite a la creación artística
La incidencia que en la libre expresión artística (objeto de expresa protección en nuestra Constitución como una de las manifestaciones del derecho fundamental a la libertad de expresión) puede presentar la moral pública, a pesar de la ausencia de mención expresa de este concepto en la Carta Magna, unida a la indeterminación que caracteriza a este término y, por ello, su contorno impreciso, motiva el interés del trabajo, cuya finalidad obedece a un triple objetivo: el análisis del alcance de los límites concretos que, desde una perspectiva jurídica, puede presentar la moral pública en la libertad de creación y producción artística y literaria, la determinación de los supuestos en que se van a lesionar bienes legalmente protegidos y la precisión de la respuesta que aporta nuestro ordenamiento frente a esas conductas dentro del marco constitucional y europeo actual, tras el cambio operado en virtud de la LO 1/2015, de reforma del Código Penal, a los efectos de proceder a su valoración.

Children and beasts in Art and the role of public morals as a limit to the artistic creation.
The impact that public morals may present in the free artistic expression (explicitly protected in our Constitution as one of the manifestations of the fundamental right of free expression), despite the absence of an explicit mention of this concept in the Constitution, united to the vagueness of this notion and thereby its indefinite shape, motivates the interest of the work, which has a triple purpose: the analysis of the scope of the specific limits that, from a juridical perspective, public morals may present in relation to the right to literary and artistic production and creation, the ascertainment of the cases in which legal interests will be attacked and the precision of the answer of our legal system to these conducts in the current constitutional and European frame, after the change operated by LO 1/2015, the reformation of the Criminal Code Act, in order to proceed to its assessment.
