Soberanía ­ ¿podemos partir todavía de que el Estado moderno goza de soberanía? ¿O es esta forma de hablar nada más que la expresión de una insistencia ciega en el uso de un concepto, vacío, que ha perdido por tanto su razón de ser? Basta echar una mirada a los Estados Unidos. Ni siquiera aquellos que desean eliminar el concepto del mundo de la terminología jurídica, se atreverían, ante la capacidad de Estados Unidos de imponer sus intereses a negarle, como mínimo, a primera vista, la soberanía a dicho Estado. En todo caso, si no es el Estado en sí mismo o todos ellos, sino sólo muchos de éstos, los que han perdido teóricamente su soberanía, tiene que existir un motivo para ello, posiblemente un motivo jurídico, que debe ser nombrado.

Sovereignty – The Defense of a Legal Concept

Sovereignty – can we still maintain the sovereignty of the modern State? Or is this rather a way of talking, a sort of blind insistence in using an empty obsolete concept? Take simply a look at the United States. Even those who desire the concept to disappear from the legal terminology would not dare denying the sovereignty of the United States, regarding the ability to impose its interests. If the State as such has not lost its sovereignty, only many of them have theoretically lost it, there must be a reason for that, possibly a legal one, which should be named.
