Sobre la «organización» en el dominio de la organización
El presente artículo profundiza en el estudio y comprensión del concepto de «organización‟ en el marco de la teoría roxiniana sobre el dominio en virtud de aparatos organizados de poder. Se efectúa un análisis del concepto de organización de Roxin -y de las críticas al mismo de Osiel-, concepto que se caracteriza por partir de una concepción burocrático-formal weberiana, para poder así comprender más claramente a qué tipo de organización se refiere la teoría. En este contexto, se hace referencia a los postulados de la sentencia de la Corte Suprema de Justicia peruana contra el ex presidente Fujimori (especialmente con relación a la disposición al hecho y a los aparatos criminales inmersos dentro de las estructuras estatales) y por otra parte a las posiciones fijadas por la Corte Penal Internacional en la decisión de confirmación de cargos en el caso Katanga para indagar en los modelos de organizaciones no estatales inmersas en conflictos armados.

About the concept of organization in the theory of control of the act by virtue of an organization.
The present paper tries to contribute to a better and more comprehensive understanding of the concept of organization within the framework of Claus Roxin‟s theory of control of the act by virtue of an organization („Organisationsherrschaft‟). Roxin‟s concept of organization will be analysed in light of the recent critique by Mark Osiel, starting from a formal-bureaucratic concept of organization in the Weberian sense. The recent case law of the Peruvian Supreme Court in the case against former President Fujimori is analysed with a view to criminal power structures within a state as well as the International Criminal Court‟s confirmation decision in the Katanga case with a view to non-state organizations in armed conflicts. In conclusion, a broader concept of organization which goes beyond a mere formal-bureaucratic model is called for. It is acknowledged that the organization is part and motor of systemic injustice and, at the same time, the sole or most important point of reference of imputation.
