En el presente artículo se expone cómo aparece y penetra la idea de que la pena debe cumplir el fin de dar satisfacción a la víctima. Se identifica en este proceso la importancia del protagonismo de las víctimas en la política criminal y del empuje desde el Derecho penal internacional, la justicia transicional y la jurisprudencia de los tribunales de derechos humanos. Se analizan críticamente diversas teorías sobre los fines de la pena orientadas a la víctima. Y se estudia qué instintos y mecanismos se encuentran realmente en la base de tal supuesta satisfacción y cómo deben manejarse en el conjunto de los fines de la pena y del Derecho penal.

On the Victim Satisfaction as Purpose of Criminal Punishment

The article aims at showing the emergence of the idea according to which the criminal punishment must
comply with the aim of granting satisfaction to the victim. The research points out the importance for this
process of both the victims’ leading role in the criminal policy and the influence of International Criminal
Law, Transitional Justice and the Human Rights bodies’ jurisprudence. This work offers a critical analysis
of different theories about the purposes of criminal punishment that are focused on victims. Besides that, it
inquires which instincts and mechanisms really lie at the core of this alleged satisfaction, as well as how
they should be dealt with in the purposes of the criminal punishment and Criminal Law as a whole.
