En 1989, la Convención de Naciones Unidas sobre los Derechos del Niño sentó las bases que han de promover la formulación de una justicia adaptada al menor. En la actualidad, dicha materia es una de las prioridades más significativas de las acciones emprendidas por el Consejo de Europa y la Unión Europea. Así se comprueba en los distintos documentos e instrumentos normativos analizados en el presente trabajo, especialmente en la Directiva 2012/29/UE. Dichas acciones se enfrentan a diversos retos, siendo dos de ellos la formulación de reglas mínimas comunes que han de regir las formalidades a las que se ha de adecuar la exploración de menores víctimas o testigos de hechos delictivos y el valor que cabe atribuir a sus declaraciones obtenidas en una fase previa al juicio. El método que se considera correcto para afrontar y superar esos retos consiste en situar en un plano de igualdad los derechos de la defensa y los derechos fundamentales del menor a la dignidad y a la integridad física y psíquica.

An European child-friendly justice: interview with children victims or witnesses in the pre-trial stage of criminal proceedings

In 1989, the United Nations Convention of the Rights of the Child paved the way for the promotion of a child-friendly justice. Nowadays, this is one of the most significant priorities of actions performed by the Council of Europe and the European Union according to the different documents and legal instruments that have been analyzed in this paper, especially the Directive 2012/92/EU. These actions face several challenges: firstly, the common minimum standards to which the formalities of interviews to child victims and witnesses should be subjected and, secondly, the value of statements given by them in a pre-trial stage of criminal proceedings. We consider that the correct method to face up and to overcome these challenges consists of placing at the same level the rights of defendants and the fundamental rights of children to both dignity and physical and psychological integrity.
