Enfrentado al “discurso del odio”, el Tribunal Constitucional ha venido desarrollando una jurisprudencia de excepción en la cual, alterando los criterios generales de interpretación constitucional, ha procedido a una progresiva limitación del ejercicio legítimo de la libertad de expresión, excluyendo de su contenido el discurso hostil y discriminatorio y omitiendo en su enjuiciamiento la valoración sobre la proporcionalidad de la restricción penal de las conductas expresivas.

Constitutional Opinions

Faced with the “hate speech”, the Spanish Constitutional Court has been developing an exceptional jurisprudence in which, changing the general criteria of constitutional interpretation, it has developed a progressive restriction of the legitimate exercise of freedom of expression, excluding from its content the hostile and discriminatory speech and leaving out the assessment of the proportionality of the criminal restriction from the expressive conducts.
