Los matrimonios forzados no han recibido una gran atención en España a excepción de iniciativas aisladas en algunas comunidades autónomas. En cambio, existe un proyecto para incluir una nueva figura delictiva de matrimonios forzados en el Código Penal, como trasposición de la Directiva Europea 2011/36/UE relativa a la prevención y lucha contra la trata de seres humanos. Este artículo analiza los pros y los contras de acudir al Derecho Penal para solucionar un problema de violencia de género con un fuerte componente cultural, especialmente a la luz de las experiencias de otros países europeos en su abordaje del fenómeno de los matrimonios forzados.

Forced marriages: another opportunity for the symbolic penal law?

Forced marriages have not received much attention in Spain except for some isolated initiatives in some autonomous communities. However, there is a project to include a new crime of forced marriage in the Penal Code, as a transposition of the Directive 2011/36/UE on preventing and combating trafficking in human beings and protecting its victims. This article analyses the arguments in favor and against of using the criminal law to solve a problem of gender violence with a strong cultural element, especially after the experience of other European countries when approaching the problem of forced marriage.
