En el presente trabajo se analiza el criterio seleccionado por el legislador para determinar al sujeto activo del delito contra la seguridad de los trabajadores (art. 316 CP español). Se exponen también las razones por las que ese criterio no resulta adecuado y se desarrollan los parámetros a los que debería responder de lege ferenda la autoría del delito mencionado, teniendo en cuenta las especiales características del ámbito de las actividades laborales y sus riesgos inherentes.

Criteria for the authorship of the offense against the safety of workers (art.316 of the Spanish CP)

In this work, we analyze the legislator’s criterion to determine the active subject of the offense against the safety of workers (Article 316 Spanish CP). We also explain the reasons for which this criterion is not adequate and we develop the parameters to which the authorship of the aforementioned offense should respond, taking into account the special characteristics of the scope of the work activities and their inherent risks.
