A vueltas con la limitación temporal de la fase de instrucción en los procesos penales: el nuevo artículo 324 LECrim

La extensión temporal de los procedimientos penales constituye actualmente una preocupación por su afectación que conlleva del derecho a un juicio rápido, reconocido como derecho fundamental tanto en textos legales internos como internacionales. Las últimas modificaciones realizadas en la Ley de Enjuiciamiento Criminal (Ley 41/2015, 05.10 y Ley 2/2020, 27.07) han introducido límites temporales a la denominada fase de instrucción del procedimiento penal. Según el propio legislador, transcurrido el plazo previsto y las posibles prórrogas, las diligencias de investigación practicadas no serán válidas. Resulta indispensable conocer el alcance de esta consecuencia y las repercusiones prácticas del transcurso del plazo establecido. Este trabajo lleva a cabo un análisis de esta cuestión proponiendo soluciones conciliadoras con el derecho a un proceso sin dilaciones indebidas y con el derecho a la tutela judicial efectiva.

Back once again to the time limitation of the investigation phase in criminal proceedings: the new article 324 LECrim

The lenght of criminal proceedings is currently a concern due to the impairment that it entails of the right to a speedy trial, recognized as a fundamental right in both domestic and international legal texts. The latest modifications made to the Criminal Procedure Law (Act 41/2015, 05.10 and Act 2/2020, 27.07) have introduced time limits to the so-called investigation phase of the criminal procedure. According to the legislator itself, after the established period and possible extensions have elapsed, the investigation activities carried out will not be valid. It is essential to know the scope of this consequence and the practical repercussions of the passing of the established period. This paper carries out an analysis of this issue proposing conciliatory solutions regarding the right to a process without undue delay as well as the right to effective judicial protection.
