Blanqueo de capitales y honorarios del defensor en el Derecho alemán

El artículo tiene como objeto la cuestión de la punibilidad a título del blanqueo de capitales –específicamente a tenor del tipo de contacto o aislamiento– de los abogados defensores por ser remunerados con dinero (u otros bienes) proveniente del delito que se le imputa a sus clientes. Dicha problemática se analiza a la luz del derecho en cuyo ámbito se ha suscitado la discusión más rica al respecto: el derecho alemán. Para ello, primeramente, se esbozan los rasgos fundamentales del tipo de obtención y de la institución de la defensa (electiva). A continuación se describe cómo la situación legal vigente en Alemania conduce a una colisión de intereses entre la necesidad de una lucha penal contra el blanqueo y el derecho del imputado a una defensa electiva efectiva. Es por eso que a continuación se presentan y ponderan las propuestas de solución, tanto la actualmente vigente del BVerfG así como las soluciones alternativas. Tras ello se expone una postura personal para lo cual se defiende la necesidad de una reducción teleológica y se discute el bien jurídico protegido por el § 261 II StGB. A continuación, se caracteriza al tipo de aislamiento como un delito de peligro abstracto contra la Administracion de Justicia, especificidad que resulta decisiva para proponer una nueva fundamentación para una restricción teleológica del tipo objetivo.

Money Laundering and Criminal Defense in German law.

The subject of this paper is the question of (specifically in the light of the contact and isolation versions) whether the defense attorneys commit the crime of money laundering when their fees are paid with money (or other assets) coming from the offenses indicted to their clients. Such question is analyzed examining the German Law, where this subject has been discussed most exhaustively. Next, the paper describes how the current legal status of the conduct in Germany leads to a collision of interests between an effective fight against money laundering and the defendant’s right to an effective and elective legal defense. This is why the paper continues analyzing the different existing solution proposals, including both, the currently maintained by the German Constitutional Court (BVrfG), and the alternative proposals. Afterwards, the personal position of the author is presented which is based on the need of a teleological interpretation of the criminal type, in the light of a discussion about the legal interest protected under § 261 II StGB. Finally, following the dominant position in Germany, the paper characterizes the isolation-type as a crime of abstract danger against the administration of justice, which becomes decisive in order to propose a new justification of a restrictive interpretation of the crime.
