¿Son legítimas las medidas de seguridad complementarias a la pena, esto es, aquellas añadidas a la pena impuesta al autor y que se ejecutan con posterioridad a la pena? Existen planteamientos filosóficos que permiten fundamentar una reacción cognitiva frente a sujetos que no ofrecen la fiabilidad cognitiva necesaria para ser tratados como personas, esto es, sujetos que no muestran en conjunto una línea de vida que permita concluir que serán fieles al Derecho. A esta cuestión se dedica este trabajo.

Coercion and personality. Reflections about a theory of the complementary measures to punishment

Are the complementary measures to the punishment, namely measures which are imposed together with and in addition to the punishment imposed as well to the perpetrator of the crime legitimate? There are philosophical approaches which make possible to found the cognitive reaction against subjects who do not offer the necessary cognitive trustworthiness to be treated as persons, namely subjects who do not show as a whole a life orientation that permits to infer that they will be faithful to the Law. That is the subject of this paper.
