En el derecho español de contratos, la buena fe se concibe como un estándar de comportamiento debido de las partes alineado con el contrato mismo (artículo 1.258 del Código Civil). Si el contrato es válido, la buena fe modula las cláusulas contractuales específicas e integrar las lagunas. Como cuestión de derecho, la buena fe contractual es siempre contextual y no permite a los tribunales de justicia o de arbitraje contradecir las cláusulas válidas de un contrato válido. Si, y solo si, algunas cláusulas fueran nulas, o todo el contrato estuviera al borde del colapso, la buena fe puede ser usada para enmendar el contenido contractual.

The contextual conception of contractual good faith in the Spanish Law of Courts. Section 1,258 of the Spanish Civil Code 1889

In the Spanish Law of Contracts, the good faith standard is conceived as a set of due behavior of the parties which is aligned with the contract itself (section 1,258 of the Spanish Civil Code). If the contract is valid, the good faith standard modulates the specific contractual clauses and fills the gaps. As a matter of rule, contractual good faith is always contextual and it does not enable Courts and arbitration panels to contradict valid clauses of a valid contract. If, and only if, some clauses are void, or the whole contract is in the verge of collapsing, can the good faith standard be used to amend the contract regulation.
