Deberes positivos del Estado y Derecho penal en la jurisprudencia del TEDH

Como parte de su vastísima jurisprudencia sobre las obligaciones positivas del Estado, que imponen a este garantizar a sus ciudadanos el disfrute efectivo de los derechos reconocidos en el Convenio Europeo de Derechos Humanos de 1950, desde hace años el Tribunal Europeo de Derechos Humanos viene desarrollando una serie de deberes estatales referidos al ejercicio del ius puniendi, construidos no desde la tradicional óptica de la garantía de los derechos del reo, sino desde la protección debida a las potenciales o actuales víctimas del delito: deberes de criminalización de las violaciones más graves de los derechos convencionales, de investigación y enjuiciamiento y de su sanción efectiva con penas suficientes, a los que se une, en un plano diferente, el deber de prevención y evitación fáctica de delitos. El trabajo da cuenta de esta doctrina y pone de relieve sus ambigüedades y riesgos, así como su en algunos extremos difícil compatibilidad con la jurisprudencia del TC español.

Positive State Duties and Criminal Law in the European Court of Human Rights’ Jurisprudence.

In the context of its wide doctrine on positive obligations, which impose on the state a duty to guarantee its citizens the effective enjoyment of their rights as recognized by the European Convention of Human Rights, the European Court of Human Rights endorses a range of state obligations regarding the exercise of the its punitive power, which depart from the usual perspective of the rights of the accused and focus instead on the protection due to the actual or potential victims of crime: duties of criminalization of the most serious offences against conventional rights, duties of investigation and trial, and duties to impose effective and sufficient punishments, as well as a state duty to prevent crime. This paper aims at explaining this doctrine, bringing into light its ambiguities and risks, as well as its (at least in some issues) difficult coexistence with the Spanish Constitutional Court’s jurisprudence.
