Delito de lesión y delito de peligro concreto: ¿qué es lo “adelantado”?

La dogmática penal de los delitos de peligro concreto ha logrado, en ciertos aspectos, un alto grado de sofisticación y detalle. Sin embargo, algunos de sus problemas centrales no han recibido suficiente atención y debate lo cual genera dificultades en la aplicación de estos tipos penales. Una de las constataciones fundamentales en cuanto al delito de peligro concreto, a partir de la cual se edifican sesudas construcciones dogmáticas, es que éste representa un adelantamiento de la punibilidad con respecto al delito de lesión. Sin embargo, se le ha dedicado poca atención a determinar qué es en verdad lo “adelantado”. En este trabajo se analiza el iter criminis de los delitos de lesión y los delitos de peligro concreto y se concluye que tanto el “comienzo de ejecución” del delito como la “tentativa acabada” se producen simultáneamente. Lo único adelantado en el delito de peligro concreto es la “consumación”. Además, se resaltan las consecuencias prácticas de estas constataciones.

Crimes involving harm and crimes of concrete endangerment, what is set back?

The dogmatic of crimes of concrete endangerment has achieved a high degree of sophistication and detail, in some respects. However, some of the most critical problems they present have received insufficient attention and debate, which creates difficulties in the application of these crimes. One of the cornerstone findings in relation to crimes of concrete endangerment, upon which thoughtful dogmatic constructions are built up, is
that it shifts back the criminality with respect to the offences of harm. However, little has been said about what is really «shifted back». In this paper, I analyze the iter criminis of the crimes of harm and crimes of concrete endangerment crimes and I prove that both the «commencement of the execution» of the crime and the «endpoint of the attempt» occur simultaneously. In crimes of concrete endangerment, only the consummation is shifted back. I intend to highlight the practical implications of these findings.
