Este trabajo aborda el problema de la actualidad de la consciencia como presupuesto del dolo, analizando su evolución histórica y adoptando una posición crítica respecto de la explicación que suele brindar la doctrina. En particular, se sostiene que este problema afecta a dos planos disímiles, no suficientemente identificados en el tratamiento habitual del tema: el de aquello a ser conocido durante el acto y el de aquello ya sabido al momento de actuar. Establecida tal diferencia, la propuesta que aquí se brinda no supone un cambio radical en cuanto a los resultados, pero sí una exposición más clara de por qué los casos problemáticos deben resolverse de tal manera. En particular, se sostiene que el presupuesto cognitivo del dolo no sólo se ve satisfecho con una consciencia actual de los elementos del tipo, sino también, en el caso de circunstancias ya sabidas, con una consciencia meramente actualizable; algo que, en el fondo, la doctrina dominante admite, pero intentando con la co-consciencia construir una ficcionada actualidad.

Dolus and Occurrent Awareness. Revisiting a Problem Identified Over a Century Ago

This paper addresses the problem of occurrent awareness as a requirement for dolus, analyzing its historical evolution and adopting a critical stance regarding the explanation usually given by legal doctrine. In particular, it is argued that this issue affects two different levels that are not sufficiently identified in the standard treatment of the subject: that which is to be known during the act and that which is already known at the time of acting. Once this distinction is established, the proposal presented here does not involve a radical change in terms of results, but it does offer a much clearer explanation of why problematic cases should be resolved in such a manner. Specifically, it is maintained that the cognitive requirement of dolus is satisfied not only by an occurrent awareness of the elements of the offence, but also, in the case of previously known circumstances, by a merely actualizable awareness; something that, fundamentally, the dominant doctrine admits, though it attempts to construct a fictionalized occurrentness through the concept of co-consciousness.
