A pesar de la reciente reforma del artículo 30 del Código civil, la consideración jurídica del nacimiento sigue siendo disconforme con las posibilidades científicas y normativas para determinar el suceso de forma razonable, objetiva y general. El criterio de vitalidad que establece la nueva regulación no resuelve ni las formas de determinación de la vida perinatal, ni el concreto momento en el que es relevante. Esos defectos, en relación con los efectos de la norma relativos al Registro civil, crean disfunciones que se harán sistémicas con la entrada en vigor de la nueva Ley, si no se remedia antes. De las anteriores circunstancias, puestas en relación con el resto del sistema jurídico y una abundante literatura médica, se concluye la ineptitud de determinadas categorías y criterios tradicionales, así como la idoneidad de interpretar el “nacimiento” como un proceso complejo cuya consumación determina, bajo apreciación facultativa, la adquisición de la personalidad a efectos civiles.

Effects and flaws of Article 30 of the Spanish Civil Code

Despite the recent reform of Article 30 of the Spanish Civil Code, the legal status of newborns is still discordant with the legal and scientific possibilities of categorizing the birth in a reasonable, objective and general way. The criterion of vitality established by the new regulation solves neither the way to determine the perinatal live, neither the relevant moment of birth. If not solved before, these defects, in relation to the effects on Civil Registry, will create systematic dysfunctions after the new Act enters into force. According to these circumstances, related to both the rest of the legal system and a substantial medical literature, it is possible to conclude the unsuitability of certain traditional categories and criteria as well as the adequacy of an interpretation of “birth” as a complex process whose consummation, under professional opinion, amounts to the beginning of the civil personality.
