Los límites del ciudadano deliberativo de Günther y Kindhäuser y del ciudadano cooperativo de Pawlik

La creciente importancia otorgada al concepto de ciudadanía por parte de la ciencia penal continental respondería a la búsqueda de una legitimación del castigo situada más allá del propio delito culpable, concretamente en el vínculo político existente entre el Estado y el ciudadano, cuyo quebrantamiento por parte de éste legitimaría al poder público para imponer el castigo. El objetivo del presente artículo es analizar las dos teorías de la ciudadanía más relevantes en la ciencia penal continental (la del ciudadano deliberativo de GÜNTHER y KINDHÄUSER y la del ciudadano cooperativo de PAWLIK) para poner de relieve su principal límite, a saber: su dificultad para justificar el castigo de quien ha sido injustamente excluido de las condiciones materiales del reconocimiento recíproco. Tras dicho análisis crítico, el artículo esboza un concepto de ciudadanía material y multidimensional mediante el cual se pueda valorar la legitimidad del castigo del excluido en función tanto del tipo de exclusión que ha sufrido como del tipo de infracción por él cometida.

The Citizen and the Excluded Towards Criminal Law.

The growing importance given to the concept of citizenship by continental criminal science would respond
to the search for a legitimation of punishment beyond the responsible offense itself, specifically in the
political link between State and citizen, whose breakdown by the latter would legitimize the imposition of
punishment. The aim of the present article is to analyze the two most relevant theories of citizenship in
continental criminal science (that of the deliberative citizen of GÜNTHER and KINDHÄUSER and that of the
cooperative citizen of PAWLIK) in order to highlight their main limit, that is: its difficulty to justify the
punishment of those who have been unjustly excluded from the material conditions of reciprocal
recognition. After this critical analysis, the article outlines a concept of material and multidimensional
citizenship through which the legitimacy of punishment of the excluded can be assessed in terms of both the
type of exclusion he has suffered and the type of offence committed by him.
