Este artículo se corresponde con el discurso pronunciado por el Prof. Claus Roxin el 30.5.2009 con motivo del 60 aniversario de la Sociedad Japonesa de Derecho Penal en Tokio, a invitación de su miembro permanente, el Prof. Makoto Ida. En el mismo, el Prof. Roxin presenta de forma crítica los rasgos fundamentales de los dos desarrollos del sistema jurídico-penal post-finalistas que mayor repercusión internacional han alcanzado. El primero es el sistema por él mismo desarrollado y fundamentado político-criminalmente, el segundo, el elaborado por el Prof. Jakobs, basado en la teoría de sistemas.

The recent development of criminal law doctrine in Germany

The paper is based on the speech held by Prof. Roxin on 30.05.2009 on the occasion of the 60th anniversary of the Japanese criminal society in Tokyo (at the invitation of the permanent board member of the Criminal Law Society Professor Makoto Ida). In this paper, Prof. Roxin presents critically the main features of the two developments of the criminal justice system post-finalists who have achieved the greatest international impact. The first is his own political-criminally informed system, the second that developed by Prof. Jakobs, based on the systems theory.
