El principio de respeto a la voluntad de la persona con discapacidad en la Convención de Nueva York (2006), y su reflejo en el anteproyecto de ley por la que se reforma la legislación civil y procesal en materia de discapacidad

La ratificación de la Convención de Naciones Unidas sobre los Derechos de las Personas con Discapacidad (2006), ha cambiado el concepto de discapacidad en nuestro Ordenamiento Jurídico español. Se aboga por un sistema de apoyo a la persona con discapacidad en la toma de decisiones, como expresión máxima de su autonomía, libertad y dignidad, garantizando el ejercicio de su capacidad jurídica, derechos y libertades fundamentales.

Las medidas preventivas de autoprotección recogidas en el Anteproyecto de Ley por el que se reforma la legislación civil y procesal en materia de discapacidad, son reflejo de la adaptación de nuestro Ordenamiento Jurídico al artículo 12 de la Convención, siendo la autocuratela una manifestación de poder donde los sujetos pueden expresar su voluntad, deseos y preferencias en torno al funcionamiento de una futura curatela.

The principle of respect to the will of the person with disabilities in the New York Convention (2006), and its reflection in the draft bill that reforms the civil and procedural legislation on disability

The ratification of the United Nations Convention on the Rights of Persons with Disabilities (2006) has changed the concept of disability in our Spanish Legal System. It advocates a system of support for people with disabilities with regards to decision making, as a maximum expression of their autonomy, freedom and dignity, guaranteeing the exercise of their legal capacity, rights and fundamental freedoms.

The preventive measures of self-protection included in the Draft Law that reforms civil and procedural legislation in matters of disability, are a reflection of the adaptation of our Legal System to article 12 of the Convention, being the institution of self-curatorship as a manifestation of power where the disabled individuals can express their will, desires and references regarding the implementation of a future curatorship.
