El recurs de cassació a Catalunya: La Llei 4/2012, de 5 de març i els seus criteris d’aplicació

La Llei 4/2012, de 5 de març, del recurs de cassació en matèria de dret civil a Catalunya, va establir una nova regulació dels requisits de l’accés a la cassació davant del Tribunal Superior de Justícia de Catalunya quan el motiu d’impugnació es fonamentava, sol o conjuntament amb altres, en una norma de l’ordenament civil català.

Aquesta norma processal catalana ha regulat de forma parcial el règim del recurs de cassació i ha estat desenvolupada per acords no jurisdiccionals de la Sala civil i penal del Tribunal Superior de Justícia de Catalunya dels anys 2012 i 2013.

El present estudi s’adreça a aprofundir aquells extrems disciplinats a la llei i els problemes interpretatius que aquests plantegen, a la llum de la doctrina del Tribunal Superior de Justícia de Catalunya, del Tribunal Suprem i del Tribunal Constitucional, i tot tenint present la recent aparició dels criteris de la Sala primera del TS de 27 de gener de 2017. Així, s’analitzen les resolucions recurribles, les infraccions al·legables i l’única llera d’accés a la cassació davant el TSJC: l’interès cassacional. Finalment, s’estudien les relacions complexes, fruits del manteniment d’una solució provisional (DF.16 LEC) entre el recurs de cassació i l’extraordinari d’infracció processal.

The cassation appeal in Catalonia: Law 4/2012 of March 5 and its application criteria

The Law 4/2012, of 5 March, on the cassation appeal in matters of civil law in Catalonia, established a new regulation governing the requirements for access to cassation before the High Court of Justice of Catalonia (TSJC) when the grounds for challenge are founded, solely or jointly with others, on a rule in the Catalan civil ordinance.

This Catalan procedural rule partially regulates the regime of the cassation appeal and has been developed from non-jurisdictional resolutions by the Civil and Criminal Chambers of the High Court of Justice of Catalonia in 2012 and 2013.

This study is addressed to going more deeply into those points disciplined in the law and the interpretation problems that they raise, in the light of doctrine of the High Court of Justice of Catalonia, the Supreme Court and the Constitutional Court, while keeping in mind the recent appearance of criteria from the First Chamber of the Supreme Court, of 27 January 2017. Thus, the analysis goes into appealable resolutions, the infringements able to be alleged and the only course of access to cassation before the TSJC: the cassation interest. Finally, the study looks at complex relationships, the fruits of maintaining a provisional solution (DF.16 LEC) between the cassation appeal and the special appeal for a procedural infringement.
