Existen dos grandes tipos de respuesta afirmativa a la reivindicación de reconocimiento del derecho a contraer matrimonio por parte de las parejas del mismo sexo: abrirles la puerta del matrimonio o crear una nueva institución. En este último supuesto, lo más frecuente es que su destinatario sean las parejas estables independientemente de que sean del mismo o de distinto sexo. En cuanto a la ampliación de la institución matrimonial a las parejas del mismo sexo, se trata por el momento de una opción claramente minoritaria. Y dentro de ésta, a su vez, es importante distinguir según el impulso inicial haya sido legislativo o judicial.

En los países donde el impulso inicial ha sido judicial, el debate, como era de esperar, se ha planteado en términos constitucionales y, más en particular, de alcance de los derechos fundamentales. Primero, si la tradicional exigencia de diversidad de sexos para el matrimonio es discriminatoria; segundo, si la decisión legislativa de ampliar el matrimonio a las parejas del mismo sexo sería constitucionalmente legítima, especialmente desde el punto de vista del derecho fundamental al matrimonio reconocido en muchos textos constitucionales y en varios tratados internacionales.

There are two main affirmative answers to the vindication of recognition of the right to marriage by same sex couples: open the door to marriage or create a new institution. In the latter case, the more usual is that the addressees are stable couples, regardless of their gender. With respect to the extension of the matrimonial institution to same sex couples, it is now a minority option. And, in this case, at the time, it is important to distinguish if the initial effort has been legislative or judicial.

In countries where the initial impulse has been judicial, the debate, as it was expected, has been presented in constitutional terms and, more particularly, in terms of the scope of fundamental rights. First, if the traditional requirement of different sex to get married is discriminatory; second, if the legislative decision of extending marriage to same sex couples would be constitutional legitimate, especially from the point of view adopted by many constitutional texts and different international treaties.
