Entre la responsabilidad y la solidaridad. El estado de necesidad defensivo
Admitiendo que la intensidad de las injerencias en intereses ajenos justificables en estado de necesidad defensivo debe ser superior a la admisible cuando se lesionan intereses de terceros en estado de necesidad agresivo, queda por resolver el tipo y la intensidad del vínculo exigible entre el peligro que amenaza y el sujeto gestor de la esfera de donde emana. En este trabajo se presentan las principales propuestas formuladas tanto en España como en Alemania para delimitar el estado de necesidad agresivo del defensivo y se examina la oportunidad de llevar a cabo distribuciones o atribuciones de cargas en situaciones de conflicto prescindiendo de los principios de imputación clásicos en Derecho penal.

Between responsibility and solidarity. The quasi-self-defence
It is a common place that the intensity of interference of outside interests justifiable in defense of quasi-self- defence must be more than acceptable when are injured the interests of others in defense of necessity. However it is yet to be solved the type and intensity of the bond required between the person in whose sphere belongs the source of danger and that danger. This paper presents the main proposals raised in Spain and Germany to delimit the defense of quasi-self-defence and the defence of necessity, and examines the opportunity to carry out load distributions or attributions in conflict situations apart from the classic criminal law imputation principles.
