El objetivo del artículo es comparar los diferentes mecanismos de solución alternativa de controversias que, entre los Estados miembros de la Unión Europea se han establecido para transponer el artículo 21 de la Directiva de Derechos de autor en el mercado único digital. El artículo se divide en dos partes, la primera estudia el sentido y alcance del artículo 21 de la Directiva y la segunda parte se dedica a un análisis de Derecho Comparado de las diversas legislaciones que han implementado dicho artículo entre los países miembros, tomando como referencia criterios como mecanismo de solución alternativa utilizado; institución que lo aplica; formación del facilitador; entre otros. La finalidad del análisis es establecer tendencias, semejanzas y diferencias en el uso de mecanismos alternativospara la solución de controversias de derechos de autor en la Unión Europea.

Comparative study of the transposition of Article 21 of the Copyright Directive and the Digital Single Market

The aim of the article is to compare the different alternative dispute resolution mechanisms that have been established among the member states of the European Union to transpose Article 21 of the Copyright Directive in the Digital Single Market. The article is divided into two parts, the first part studies the meaning and scope of Article 21 of the Directive and the second part is dedicated to a Comparative Law analysis of the various legislations that have implemented said article among the member states, taking as reference criteria such as ADR mechanism used; institution that applies the ADR; training of the facilitator; among others. The purpose of the analysis is to establish trends, similarities and differences in the use of ADR for the settlement of copyright disputes in the European Union.
