Fundamento y fines del Derecho penal. Una revisión a la luz de las aportaciones de la neurociencia

Este trabajo plantea una reflexión sobre un tema tradicional, los fines del Derecho penal, a partir de la irrupción en el debate jurídico-penal de los neurocientíficos quienes se decantan por una fundamentación preventivo general o preventivo especial de la pena. Más allá de sugerir el carácter incompleto del análisis realizado por los neurocientíficos al referirse a la fundamentación del Derecho penal, en el trabajo se identifican algunas de las aportaciones de la Neurociencia al debate de los fines de la pena, señalándose algunos límites a la utilización legítima del tratamiento neurológico como instrumento de prevención especial.

Foundations and purposes of criminal law. A review in the light of the contributions of neuroscience

Recent neuroscientific discoveries begin to influence the legal discussion on classical topics such as notion and ground of the mens rea and punishment justification (Retributivism v. Consequentialism). This work deals with the arguments of neuroscientists, who defend a consequentialist theory of Punishment – general deterrence or rehabilitation-, and point out the gaps in their analysis and some potential contributions of the Neuroscience, especially in the field of neurological interventions of violent criminals as a way to their rehabilitation or to lessen the risk of recidivism. This paper also addresses the legitimate –ethical and legal- neurological treatment conditions.
