Internet, incitación al terrorismo y libertad de expresión en el marco europeo

Este trabajo tiene por objeto estudiar desde la perspectiva europea el delito de incitación y de apología o enaltecimiento del terrorismo, con especial interés en las peculiaridades que se presentan cuando estas conductas se ejercen a través de Internet. Se tomará como referencia la tipificación ofrecida por la Directiva 2017/541 del Parlamento europeo y del Consejo, de 15 de marzo, relativa a la lucha contra el terrorismo, y la actual regulación de estos delitos en el Código penal español. Asimismo, en la medida que estos delitos interfieren en la libertad de expresión, se buscará el estándar de protección más adecuado a la luz de la jurisprudencia del Tribunal Europeo de Derechos Humanos, contrastándola a su vez con la del Tribunal Supremo norteamericano. Todo ello para poder realizar una propuesta de redefinición de estos delitos de corte más garantista y que responda a las necesidades derivadas de la difusión de este tipo de mensajes a través de Internet.

Internet, Incitement to terrorsim and freedom of expression in the European framework.

This work aims to study from the European perspective the offence of incitement and apology or glorification of terrorism, with special interest in the peculiarities that arise when these behaviors are exercised through the Internet.The paper will take as reference the typification offered by Directive 2017/541 of the European Parliament and the Council, of March 15, related to the fight against terrorism, and the current regulation of these offences in the Spanish Penal Code.Also, considering that these offences collide with freedom of expression, we will seek the most appropriate standard of protection in light of the case-law of the European Court of Human Rights, contrasting it with the Supreme Court of the United States doctrine.
