El presente trabajo aborda el estudio legal, jurisprudencial y doctrinal acerca de la competencia constitucional para legislar sobre derecho civil en España. Asimismo, analiza el alcance e interpretación de la controvertida competencia de la Comunidad Valenciana para legislar sobre su propio derecho civil. A tal fin, se parte de una aproximación a los antecedentes históricos hasta llegar a la reciente jurisprudencia del Tribunal Constitucional sobre la cuestión, sobre todo la que afecta a la impugnación y anulación de las leyes valencianas de derecho de familia.

The legislative competence in civil law of article 149.1.8ª of the Spanish Constitution. Dysfunctions around the Valencian civil law and interpretation of the Constitutional Court

This article deals with the legal, jurisprudential and doctrinal study on the constitutional competence to legislate on civil law in Spain. It also analyzes the scope and interpretation of the controversial competence of the Valencian Community to legislate on its own civil law. To this end, it is based on an approximation from the historical background to the recent jurisprudence of the Constitutional Court on the issue, especially the one that affects the rejection and annulment of Valencian family laws.
