El comentari se centra en la impugnació de l’assemblea general de l’Associació El Papagayo, per irregularitats en el seu funcionament, en concret respecte de la designació del president i el secretari de l’assemblea al seu inici. El TSJC estima que no haver-los nomenat a l’inici atempta contra la llei, en front dels recurrents, que ho assimilen amb una infracció estatutària. La distinció és rellevant a efectes dels terminis per l’acció d’impugnació. En front del criteri del TSJC, considerem que és una irregularitat lligada a una llei dispositiva, que donaria lloc a la possibilitat d’impugnació durant només el termini de 40 dies. També s’aborda la competència autonòmica en matèria processal –perquè apareix indirectament a la decisió judicial- i s’aposta per recórrer a la mediació com a millor mecanisme per conflictes com aquest.

The Impugnation of the General Assembly of a Property Owners Association, by default of initial Designation of the President and the Secretary

This article analyses the impugnation of the general Assembly of the Association The Papagayo, by irregularities in his constitution, specifically concerning the designation of the president and the secretary of the Assembly at the beginning. The TSJC considers that the default of this designation goes against the law, in front of the appellants, that assimilate the case to a statutory infringement. The distinction is important in order to the deadline to act the impugnation action. In front of the criterion developed by the TSJC, we consider that the irregularity affects to a not imperative norm, which allows the possibility of impugnation during only 40 days. The text also deals with state and autonomic competence in procedural matter –because it appears indirectly in the judicial decision- and it suggests to turn up for mediation as the best mechanism for conflicts like this.
