La interrupción de la prescripción del delito en el Derecho penal de menores

La LORPM no prevé expresamente en su redacción un criterio que indique cómo debe interpretarse la interrupción del plazo de prescripción de una infracción penal presuntamente cometida por un menor de edad. Atendiendo al carácter supletorio del Derecho penal de adultos será de aplicación lo dispuesto en el art. 132 CP. Este precepto exige para poder considerar interrumpida la prescripción la existencia de una resolución judicial motivada que atribuya al menor su presunta participación en un hecho constitutivo de delito. Sin embargo, las peculiaridades del sistema de justicia penal juvenil condicionan en gran medida la discusión acerca de la concurrencia de los requisitos previstos en el CP de adultos y aplicados supletoriamente en este ámbito, principalmente porque la función instructora no corresponde al Juez de Instrucción sino al Ministerio Fiscal. Por lo tanto, resulta clave delimitar cuándo se entiende interrumpida la prescripción penal de la infracción penal en la jurisdicción penal de menores, dado que es posible que la instrucción de los delitos (en especial los leves) sobrepase el plazo de prescripción establecido por la LORPM y tenga como consecuencia el archivo de las actuaciones. En esta investigación se analizan las interpretaciones ofrecidas por la doctrina y jurisprudencia, a la vez que se plantea una propuesta de modificación lege ferenda del art. 15 LORPM.

The interruption of the prescription of the crime in juvenile criminal law

The LORPM does not expressly provide in its wording a view that indicates how to interpret the interruption of the statute of limitation for a criminal offense committed by a minor. Considering the supplementary nature of adult criminal law, the provisions of art. 132 Criminal Code will be applied. To consider that the statute of limitation has been interrupted this article requires the existence of a reasoned judicial decision that attributes to the child his presumed participation in an act that constitutes a crime. However, the particularities of the juvenile criminal justice system determines the discussion about the concurrence of the requirements established in the Criminal Code for adults and supplementary applied in this area, mainly because the instructor function does not correspond to the Instructor Judge but rather to the Prosecutor. Therefore, in the juvenile criminal jurisdiction it is key to define when the statute of limitation in a criminal offense is interrupted, insomuch as it is possible that the investigation of crimes (especially the minor offenses) exceeds the statute of limitations established by the LORPM and have as a consequence the file of the process. The interpretations offered by the doctrine and the jurisprudence are analyzed, at the same time as a lege ferenda reform proposal of art. 15 LORPM is provided.
