La crisi de confiança de la ciutadania en les institucions i administracions públiques ha anat en augment darrerament, nodrida per factors com la opacitat en la seva gestió. En aquest context, la transparència i el dret d’accés a les dades i a la informació de què disposen els poders públics s’han revelat com a instruments cabdals no només per apropar aquests a la ciutadania sinó també per obrir-los a la participació en els processos de decisions que els afecten. Darrerament, tant l’Estat com diverses comunitats autònomes han legislat al respecte. Precisament, el present treball analitza, a partir de la Llei catalana 19/2014, de transparència, accés a la informació pública i bon govern analitza els problemes derivats de la concurrència entre l’Estat i les comunitats autònomes, en concret l’aplicabilitat de la legislació bàsica estatal i alguns dels aspectes substantius més rellevants de la normació catalana.

Transparency and the right of access to public information in catalan law 19/2014. Reflection about its scope and competence framew

The crisis of public confidence in government institutions has increased lately, nourished by factors such as opacity in its management. In this context, transparency and the right of access to data and information available to the public authorities have been revealed as a key instrument not only to bring these citizens but also to open up participation in making processes that affect them. Recently, both the state and several regions have legislated respect. Indeed, the present study from the Catalan Law 19/2014, of transparency, public access to information and good governance discusses the problems of competition between the state and the regions, in particular the applicability of the basic state legislation and some of the most important substantive aspects of the catalan legislation.
