Advance will, substituted judgment and best interest in the informed consent of people with disabilities in the health field

This paper examines the right of people with disabilities to make their own
decisions in the field of healthcare. In particular, the article focuses on the
informed consent from the Spanish and Catalan perspective. Health regulations
have not been adapted to the United Nations Convention on the Rights of Persons
with Disabilities, which generates contradictions with the new paradigm that need
to be rectified. It lists the cases in which the person with a disability can consent
and the cases in which another person with representative functions consents.
These cases lead to the analysis of the advance will, substituted judgment, and the
patient’s best interests. The work concludes with a jurisprudential study that
announces frictions with the new regulation.
