La sociedad actual debe dar respuesta a los retos que plantea el envejecimiento de la población, regulando materias, modificando normas, reinterpretando las existentes y fomentando instrumentos que mejoren las condiciones de vida del mayor. Con éste interés, se analiza si el abandono emocional puede ser considerado causa de desheredación permitiendo al testador sancionar por ese motivo a sus descendientes.

Mistreatment and emotional neglect as a cause of disinheritance

Today´s society must respond to the challenges caused by the aging population, creating legal rules, modifying, reinterpreting existing norms and promoting instruments that improve the lives of the elderly. For this purpose we analyze if the emotional neglect may be considered cause for disinheritance in order to those allows the testator sanction for that reason their descendants.
