Pena, delito y sistema del delito en transformación

El delito, la pena, y la teoría de la pena, todos ellos conceptos fundamentales del Derecho penal, se hallan en las últimas décadas –nuevamente- inmersos en un proceso de transformación. Mientras que en el caso del concepto de delito este proceso se plasma en definiciones e intentos de explicación del hecho punible enfrentados entre sí, en el caso de la pena y de las teorías de la pena dicha evolución supone más bien el abandono discreto y silencioso de aquellos postulados básicos sobre los cuales venía debatiéndose de manera enérgica desde hace décadas. El presente trabajo pretende poner de manifiesto que ambos fenómenos y procesos de evolución están interrelacionados. Al mismo tiempo, se debería también aquí lograr poner de relieve que ciertas formas nuevas de comprensión del delito no constituyen tan solo un pasatiempo teórico, sino que abren, a su vez, nuevas y fértiles perspectivas para el sistema del delito.

Punishment, crime and crime system in the midst of change

During the last decades the fundamental criminal concepts of crime and punishment as well as the theory of criminal justice are changing – once again. Whereas in the concept of crime this finds an expression in competing definitions and attempts of interpretation, in the fields of punishment and of the theory of criminal justice this is rather reflected in the implied abandonment of positions around which there have been intense discussions for decades. In my article I want to show that both phenomena and evolutions have something to do with one another. The intention is also to demonstrate that certain new ways of understanding the crime are not merely theoretical pastimes, but that they provide the crime system with new and fruitful perspectives.
