El presente trabajo recoge una reflexión sobre cuál debería ser el tratamiento jurídico-penal adecuado de las conductas incorrectas de los peritos en los procesos penales que tienen por objeto conductas especializadas. Tras aproximarse a la función realmente asumida por los peritos en dichos procesos, la cual abarcaría no solo el informar sobre hechos, sino también la identificación de normas de conducta, su interpretación y aplicación a los hechos – excediendo claramente la función que les asigna el Derecho positivo -, el trabajo se detiene en la respuesta jurídico-penal vigente a las conductas incorrectas de los peritos (el tipo de falso testimonio), analiza las propuestas que se han formulado para dar un tratamiento jurídico adecuado a las conductas de los peritos y concluye con la propuesta de lege ferenda de un tipo penal que recoja el injusto específico del perito que informa incorrectamente sobre el Derecho y, con ello, infringe su deber institucional específico de auxiliar al juez en cuestiones de Derecho.

Expert witnesses and false testimony. A reflection on their institutional function in the criminal proceedings

This article addresses the question of the appropriate criminal law approach to the misconduct of experts witnesses in criminal proceedings involving specialised conducts. First, the function that experts actually assume in such proceedings is analysed. This function includes not only the determination of facts, but also the identification of norms of conduct, their interpretation and application to the facts of the case, which goes beyond the function assigned to experts by positive law. Thereafter, the article focuses on the current criminal law response to expert witness misconduct (the offence of false testimony in criminal proceedings), analyses the proposals that have been formulated in order to provide an appropriate legal treatment of the conduct of expert witnesses, and concludes with a proposal to introduce a new criminal offence covering the specific misconduct of the expert who provides false information about the law and thus violates his or her specific institutional duty to assist the judge in matters of law.
