La Ley 19/2022, de 30 de septiembre, ha reconocido personalidad jurídica al Mar Menor y su cuenca, introduciendo en nuestro Derecho, y consecuentemente en Europa, un paradigma interpretativo ecocéntrico en lo que a la protección del medio ambiente se refiere, considerando a dicho ecosistema titular de derechos en beneficio propio. El Tribunal Constitucional ha considerado conforme con la Constitución el referido cambio de paradigma en la reciente STC 142/2024, de 20 de noviembre. Sin embargo, la fundamentación ofrecida por el máximo intérprete de la Constitución en este pronunciamiento no tiene la solidez que es dable esperar del máximo intérprete de la Constitución cuando se trata de justificar una cuestión tan relevante como es el cambio de paradigma en la interpretación de los derechos, concretamente del derecho a disfrutar de un medio ambiente adecuado.

Legal personality of the Mar Menor and change of paradigm in the interpretation of the environment: critical considerations of STC 142/2024

Law 19/2022, of 30 September, has recognised the legal personality of the Mar Menor and its basin, introducing in our Law, and consequently in Europe, an ecocentric interpretative paradigm as far as environmental protection is concerned, considering this ecosystem to be the holder of rights for its own benefit. The Constitutional Court has considered this change of paradigm to be in accordance with the Constitution in the recent STC 142/2024, of 20 November. However, the reasoning offered by the highest interpreter of the Constitution in this pronouncement does not have the solidity that is to be expected from the highest interpreter of the Constitution when it comes to justifying such a relevant issue as the change of paradigm in the interpretation of rights, specifically the right to enjoy an adequate environment.
