El desarrollo alcanzado por la Inteligencia Artificial durante los últimos años ha dado lugar al planteamiento de la posibilidad de atribuir personalidad jurídica a estos sistemas tecnológicos bajo el argumento de facilitar la responsabilidad civil por daños causados como consecuencia del funcionamiento de dichos sistemas. Ello se ha plasmado tanto a nivel de propuestas doctrinales como, de forma muy secundaria, en algún texto de la Unión Europea.

Pese a que se trata de una opción en este momento descartada a nivel de Derecho comunitario, se considera conveniente aportar una visión del tema que tenga en cuenta las siguientes cuestiones: el trasfondo transhumanista que subyace en este tipo de planteamientos; la centralidad de la persona para el Derecho y, particularmente, para el Derecho Civil; los propósitos que pudieran estar detrás de esta hipótesis; su innecesaridad desde el punto de vista jurídico y, finalmente, su imposible encaje en la tipología de personas jurídicas que contempla el Derecho español, con fundamento constitucional. Y ello porque la que se anuncia como evolución exponencial de la robótica pudiera dar lugar en un futuro no muy lejano al resurgimiento de la hipótesis.

Legal personality and Artificial Intelligence

The development achieved by Artificial Intelligence in recent years has given rise to the possibility of attributing legal personality to these technological systems under the argument of facilitating civil liability for damages caused as a result of the operation of these systems. This has been reflected both at the level of doctrinal proposals and, in a very secondary way, in some European Union texts.

Although this is an option that has been ruled out at the moment in Community Law, it is considered appropriate to provide a vision of the subject that takes into account the following issues: the transhumanist background that underlies this type of approach; the centrality of the person for the Law and, particularly, for Civil Law; the purposes that could be behind this hypothesis; its unnecessity from a legal point of view and, finally, its impossible fit into the typology of legal persons contemplated by Spanish Law, with a constitutional basis. And this is because what is announced as the exponential evolution of robotics could lead to the resurgence of the hypothesis in the not too distant future.
