La teoría de la prevención general positiva padece de un cierto grado de ambigüedad, lo que hace necesario realizar algunas distinciones analíticas. Dentro de los fines que se quieren alcanzar por medio de esta teoría, se puede reconocer un objetivo pedagógico. A este respecto también se debe diferenciar entre dos posibles fines educativos a alcanzar, que, a su vez, dependen completamente del respectivo concepto de norma que se utilice. Se puede partir, por un lado, de un concepto de norma que pone su acento en el valor por ella contenido. Por el otro, también se puede colocar la acentuación en el valor de la norma como parte del sistema normativo. Si se trabaja con este segundo concepto de norma, se puede lograr un efecto pedagógico en la sociedad, que no sólo es útil para la protección de bienes jurídicos, sino que todavía sigue siendo liberal.

The theory of the positive general prevention suffers from a certain degree of ambiguity, which makes it necessary to carry out some analytical distinctions. Within the purposes to be achieved through this theory, a pedagogic objective can be recognized. As regards the latter, we must differentiate between two possible educational aims, which are to be reached. These aims depend completely on the concept of norm one actually uses. On the one hand, one can begin with a concept of norm, which stresses the value contained by it and, on the other hand, one can stress the value of the norm itself as a part of the normative system. If we work with this second concept of norm, we can achieve a pedagogical effect on society, one that is not only useful to protect legal goods, but which it is still liberal.
