El Govern de la Generalitat de Catalunya, en la sessió del 29 de novembre de 2022, va aprovar el Projecte de llei d’actualització, incorporació i modificació de determinats articles del Codi civil de Catalunya. Aquest projecte de llei ha estat en tramitació al Parlament de Catalunya fins a la dissolució anticipada de la legislatura, per la convocatòria d’eleccions pel president de la Generalitat, amb el Decret 60/2024, de 18 de març. Durant la tramitació parlamentària en la Comissió de Justícia del Parlament els grups parlamentaris van proposar la compareixença d’organitzacions interessades i persones expertes, mitjançant el tràmit d’audiència en ponència, previst a l’article 117.2 del Reglament del Parlament de Catalunya, per tal de donar la seva opinió per escrit sobre el projecte de llei. Es publica el document elaborat per a aquesta compareixença en relació amb el Projecte de llei de modificació del Codi civil de Catalunya. En el document s’inclou el text dels articles del projecte que proposen modificacions als Llibres primer, segon, quart, cinquè i sisè del Codi civil de Catalunya, amb l’excepció dels relatius al Llibre tercer, sobre persones jurídiques. Es formulen acotacions, comentaris i propostes d’esmena al text de cadascun d’aquests articles, amb alternatives de redacció o de supressió. L’anàlisi del projecte de llei es porta a terme tenint en compte l’obra del Codi civil de Catalunya, el seu caràcter de conjunt normatiu codificat, com a sistema coherent i complet en el marc de l’ordenament jurídic català. Les acotacions, els comentaris i les propostes d’esmena es refereixen al sentit de la modificació proposada, el seu impacte i concordança en relació amb la normativa vigent, així com les dificultats tècniques i pràctiques que pot plantejar la seva aplicació. És en aquest sentit que es proposen redaccions alternatives dels preceptes projectats. Es publica per l’interès que pot tenir en relació amb el procés de codificació del dret civil català.

The Bill concerning the update, incorporation, and amendment of certain articles of the Civil Code of Catalonia. Quotations, comments, and amendments proposals

The Government of Catalonia, in its session of November 29, 2022, passed the Bill concerning the update, incorporation and amendment of certain articles of the Civil Code of Catalonia. This bill was being processed in the Parliament of Catalonia until the dissolution of the legislature, due to the calling of elections by the Catalan President, with Decree 60/2024, of 18 March. During the parliamentary process in the Justice Committee, the parliamentary groups proposed the hearing of organizations and experts, according to the article 117.2 of the Regulation of the Parliament of Catalonia, to give their opinion in writing on the bill. The document prepared for this hearing includes the text of the articles of the project that propose modifications to the first, second, fourth, fifth and sixth books of the Civil Code of Catalonia, except for the third book, on legal entities. In the document there are formulated quotations, comments, and amendments to the text of each of these articles of the bill, with alternatives or proposals of suppression. The analysis of the bill is carried out considering the codification process of the Civil Code of Catalonia, its character as a codified normative set, as a coherent and complete system within the framework of the Catalan legal system. The quotations, comments and proposed amendments refer to the purpose of the modifications of the bill, its impact and consistency in relation to the current legislation, as well as the technical and practical difficulties that may arise in its application. It is in this sense that alternative wordings of the projected articles are proposed. It is published in InDret because of the interest it may have in relation to the codification process of Catalan civil law.
