El presente artículo pretende clarificar la consideración legal de las conductas de uploading y downloading, distinguiendo aquellas que son lícitas, aquellas que constituyen ilícito civil y las que pueden considerarse delictivas. Para ello previamente se insiste en la distinción entre los ilícitos civiles contra la LPI y los delitos contra la propiedad intelectual, poniendo el acento en el análisis de los elementos típicos «ánimo de lucro» y «en perjuicio de tercero», tal y como los han interpretado la doctrina, los tribunales y la propuesta de solución propia. Por último se propone establecer deberes de control para los titulares de servidores p2p cuya infracción daría lugar a sanciones administrativas. Para ello se sugiere un sistema de filtro de contenidos protegidos basado en el hash del fichero.

About the criminality of the conduct of uploading a copyrighted work with commercial intent and the not criminal character of its downloading despite its illegality. At the same time a technical and legal solution to the violation of intellectual property rights through p2p networks

This paper seeks to clarify the legal treatment of the conduct of uploading and downloading, distinguishing those that are allowed, those that are a civilly wrong and those that are criminal. In order to do so we will distinguish between torts against the Intellectual Property Law and crimes against intellectual property, with emphasis on the analysis of the elements of the crime: «animus lucrandi» and «causing a loss», as they have been interpreted in doctrine, by the courts and in this proposed solution. Finally we propose to establish a means of control for the owners of p2p servers and administrative sanctions for the violation of these means. To achieve that we suggest a system to filter the protected contents based on the hash of the file.
