La “subsunción alternativa en la condena propia” (“Wahlfeststellung”) es una forma de condena penal aplicada en Alemania. De acuerdo con ella, si al momento de dictarse sentencia, y tras haberse agotado todos los medios de prueba, es seguro que el acusado cometió uno de entre varios delitos determinados pero no se puede establecer cuál de ellos es el que efectivamente realizó, la jurisprudencia –respaldada por la doctrina mayoritaria de ese país– admite que el acusado pueda ser condenado por haber cometido un delito u otro de manera alternativa. Esta forma de condena cuenta con más de ocho décadas de aplicación ininterrumpida en ese país. Sin embargo, a principios de 2014 la 2ª Sala Penal del BGH sostuvo que violaba el principio de legalidad, y consultó a las otras salas del máximo tribunal alemán penal si estaban dispuestas a cambiar de criterio. Las cuatro salas restantes, sin embargo, se pronunciaron a favor de la constitucionalidad de este instituto. Sólo resta que se pronuncie el pleno. En este artículo se pretende, por un lado, explicar en qué consiste esta forma de condena, y, por el otro, mostrar que viola no sólo el principio de legalidad (como lo dijo la 2ª Sala del BGH), sino también el principio de presunción de inocencia (en particular del in dubio pro reo) y el derecho de defensa.

Alternative conviction: Analysis about her constitutional legitimacy

The so called “alternative conviction” (“Wahlfeststellung”) is a special type of criminal conviction in Germany. It presupposes that, when all available evidence has been considered and judgment is to be rendered, the court finds it established that the accused committed one of two (or more) offences, but it is impossible to prove which one precisely. Under these circumstances, German courts – supported by the prevailing opinion in the literature – convict the accused for having committed either one or the other offence. This concept has been continuously applied during the last eight decades. In early 2014, however, the second criminal senate of the Federal Court of Justice (“Bundesgerichtshof”) considered it to violate the principle of legality and asked the other senates of the highest German criminal court whether they would agree to change the case-law. Meanwhile, the other four senates have made it clear that they consider the possibility of an alternative conviction constitutional. Therefore, the case is now pending before the “Grand Senate for Criminal Matters”, which will have the task to finally answer this question. The present contribution shall – on the one hand – explain the idea behind this special type of conviction. On the other hand, it will illustrate that it does not only infringe upon the principle of legality (as stated by the second criminal senate), but also the presumption of innocence (particularly the principle of in dubio pro reo) and the right to an effective defence
