Una cartografía de las actuaciones procesales automatizadas: concepto, límites y garantías

El trabajo analiza el régimen jurídico de las actuaciones procesales automatizadas introducidas por el RDL 6/2023, destacando que no constituyen una mera manifestación de la digitalización, sino una transformación en el modo de producción de determinados actos procesales. Se delimita su concepto y alcance, sosteniendo que no comprenden sistemas de inteligencia artificial, sino tecnologías deterministas basadas en reglas. Desde esta perspectiva, el fenómeno se reconduce a la computarización del derecho, entendida como la traducción de normas a código ejecutable. En el plano dogmático, se defiende su compatibilidad con la teoría del acto procesal, al mantenerse su imputación institucional al órgano jurisdiccional. No obstante, se subraya la insuficiencia del marco normativo vigente y la necesidad de reforzar las garantías de diseño y funcionamiento. Finalmente, se sostiene que la configuración de estos sistemas tiene naturaleza normativa y debe respetar la competencia estatal en materia procesal.

Mapping Automated Procedural Acts: Concept, Limits, and Safeguards

This article examines the legal regime governing automated procedural acts introduced by RDL 6/2023, emphasizing that they do not merely represent a form of judicial digitalization, but rather a transformation in the way certain procedural acts are produced. It defines their concept and scope, arguing that they do not encompass artificial intelligence systems, but rather deterministic, rule-based technologies. From this perspective, the phenomenon is reframed as the computerization of law, understood as the translation of legal norms into executable code. From a doctrinal standpoint, the paper argues for their compatibility with the theory of procedural acts, insofar as their institutional attribution to the judicial body is preserved. Nevertheless, it highlights the shortcomings of the current regulatory framework and the need to strengthen safeguards in both design and operation. Finally, it contends that the configuration of these systems is inherently normative in nature and must comply with the State’s competence in procedural matters.
