Una visión panorámica de la regulación del beneficio de la exoneración del pasivo insatisfecho en el texto refundido de la Ley Concursal y en la Directiva (UE) 2019/1023

En el presente trabajo se aborda el nuevo paradigma del beneficio de la exoneración del pasivo insatisfecho (BEPI) tras la promulgación de la Directiva (UE) 2019/1023, sobre reestructuración e insolvencia, la aprobación del texto refundido de la Ley Concursal y la normativa de emergencia dictada a raíz de la pandemia.

Sin perjuicio de que el nuevo texto refundido incorpore novedades de redacción y matizaciones significativas respecto de la regulación anterior del BEPI, el legislador español deberá acometer importantes reformas para transponer correctamente la Directiva y cumplir así con el mandato europeo.

A panoramic view of the regulation of the benefit from the discharge of unsatisfied liabilities in the consolidated text of the Bankruptcy Law and in the Directive (EU) 2019/1023.

This paper addresses the new paradigm of the benefit from the discharge of unsatisfied liabilities after the enactment of Directive (EU) 2019/1023, on restructuring and insolvency, the approval of the consolidated text of the Bankruptcy Law and regulations dictated because of the pandemic.

Without prejudice to the fact that the new consolidated text incorporates drafting changes and significant qualifications with respect to the previous benefit from discharge of unsatisfied liabilities regulation, the Spanish legislator must undertake important reforms to correctly transpose the Directive and thus comply with the European mandate.
