En el marco de la estrategia de la Unión Europea sobre el tránsito hacia el paradigma de la economía circular, se están impulsando, desde diferentes ámbitos normativos, la reutilización de productos ya introducidos en el mercado o puestos en servicio, mediante el reacondicionamiento y la refabricación de bienes. Ambos procesos ya aparecían tímidamente en la legislación europea. No obstante, la irrupción de los bienes con elementos digitales y con el impulso de la economía circular han sido los elementos que han propiciado la necesidad de poner el foco legislativo sobre esta categoría de bienes. Actualmente, nos encontramos en un momento de cambios legislativos profundos, donde la Unión Europea está adoptando nuevos reglamentos y directivas que actualizan los principios sobre los que se han asentado el derecho contractual europeo y el derecho de daños. El presente trabajo se propone analizar cuál es el tratamiento dispensado a los bienes reacondicionados y refabricados a la luz del estado legislativo actual y qué consecuencias tiene para la responsabilidad del fabricante que se acometan estos procesos mediante una modificación sustancial de sus productos.

Refurbishment, remanufacturing and substantial modification of products

Within the framework of the European Union’s strategy on the transition to the circular economy paradigm, the reuse of products already on the market or put into service, through the refurbishment and remanufacturing of goods, is being promoted in different regulatory spheres. Both processes were already timidly appearing in European legislation. However, the irruption of goods with digital elements and the promotion of the circular economy have been the elements that have led to the need to put the legal focus on this category of goods. We are currently at a time of deep legislative changes, where the European Union is adopting new regulations and directives that update the principles on which European contract law and tort law have been based. This paper aims to analyze how refurbished and remanufactured goods are dealt with in the light of the current state of the art and what are the consequences for the liability of the producer when these processes are undertaken by a substantial modification of its products.
